1. About These Terms

2. Company Information

Company type: Private limited company
Jurisdiction: England and Wales
Incorporated: 29 January 2021
Registered office: 167-169 Great Portland Street, 5th Floor, London, England, W1W 5PF

3. Account Registration

To use services that require an account, you must provide information that is accurate, complete and current. You are responsible for keeping your account information up to date and for maintaining the confidentiality of your login credentials.

You must not register using another person's identity, provide deliberately misleading information, create an account for an unlawful purpose, or allow another person to use your account in a way that breaches these Terms.

4. Account Security

You are responsible for protecting your password, one-time passwords, transaction PIN, recovery information and devices used to access FinPay. You should never disclose an OTP or transaction PIN to another person, including someone claiming to be a FinPay representative.

If you believe that your account or security credentials have been compromised, you should contact FinPay support as soon as reasonably possible.

5. Verification and Customer Information

FinPay may require identity, address, contact, bank-account or other information before enabling particular features or completing certain transactions. Verification requirements may differ according to the service, account status, country and applicable requirements.

FinPay may request additional information where necessary to protect an account, investigate suspicious activity, verify a transaction or comply with applicable obligations.

6. Platform Services

FinPay may make available account, wallet, payment, transfer, deposit, withdrawal, transaction-history, bank-account and other digital services. The availability of any particular service is not guaranteed and may depend on customer eligibility, verification, jurisdiction, technical availability and other conditions.

FinPay may add, modify, suspend or discontinue features where reasonably necessary for security, maintenance, service changes, provider requirements or other legitimate operational reasons.

7. Deposits and Account Funding

Where funding functionality is available, the customer is responsible for providing accurate payment or deposit information and for reviewing the amount and destination before confirming a transaction.

Funding transactions may be subject to verification, review, processing times, third-party provider requirements and applicable charges.

8. Withdrawals and Transfers

Withdrawal and transfer requests may be subject to account verification, available balance, transaction limits, security controls, destination checks and applicable fees.

A request may be held for review before completion. Where a blockchain transaction has been broadcast or confirmed, reversal may not be possible.

9. Digital Asset Transactions

Where digital-asset functionality is made available, customers are responsible for checking the destination address, asset and network before submitting a transaction. Blockchain transactions can be irreversible and may be affected by network congestion, network fees, confirmation times and technical conditions outside the platform.

Digital assets can also be volatile. A customer is responsible for understanding the risks associated with the relevant asset before initiating a transaction.

10. Fees and Charges

Applicable charges are presented through the relevant FinPay service or transaction flow. Customers should review the displayed amount, applicable fee, conversion information and final amount before confirming a transaction.

Where the applicable crypto-withdrawal flow displays a 2% commission, that commission is calculated from the requested withdrawal amount as shown in the transaction flow.

11. Activation and Account Requirements

Some FinPay services may require an account to satisfy an activation, verification or other service-specific requirement before a transaction can proceed. Where a payment or charge is required, the applicable amount and purpose should be displayed before the customer confirms the payment.

12. Prohibited Activities

You must not use FinPay for fraud, theft, money laundering, terrorist financing, sanctions evasion or any other unlawful purpose. You must not attempt to gain unauthorized access to another account, interfere with the platform, introduce malicious software, manipulate transactions, submit false information or misuse another person's identity.

13. Transaction Review and Restrictions

FinPay may review, delay, restrict or decline an account activity or transaction where reasonably necessary for security, verification, fraud prevention, risk management, technical reasons, provider requirements or applicable law.

14. Third-Party Services

Some FinPay functions may depend on banks, payment providers, identity-verification providers, blockchain networks, market-data sources, hosting services or other third parties. Their availability, processing times and requirements may affect the availability or timing of a FinPay service.

15. Communications

By maintaining an account, you consent to receive service-related communications at the email address or mobile number registered with FinPay. These may include OTPs, security alerts, verification notices, transaction updates and important account information.

16. Intellectual Property

The FinPay website, software, interface, branding, text, graphics and other original content are protected by applicable intellectual-property laws. You may use the platform only for its intended purpose and may not reproduce, modify, distribute or commercially exploit FinPay content without permission.

17. Suspension or Closure

FinPay may suspend, restrict or close an account where permitted by applicable law and where reasonably necessary because of a security concern, suspected misuse, inaccurate information, violation of these Terms, service restrictions or other legitimate operational reasons.

18. Disclaimer of Certain Risks

FinPay does not guarantee uninterrupted availability of every service. Internet connectivity, telecommunications, banks, payment networks, blockchain networks and third-party systems may experience failures or delays.

Nothing in these Terms removes or limits a right or liability that cannot lawfully be excluded or limited under applicable law.

19. Customer Responsibility

You are responsible for reviewing transaction details before confirmation, protecting your account credentials, providing accurate information and complying with applicable laws when using the platform.

20. Changes to These Terms

FinPay may amend these Terms when necessary. Updated Terms may be published through the website or platform. Continued use of the relevant services after an effective change constitutes acceptance of the updated Terms to the extent permitted by law.

21. Governing Law and Jurisdiction

These Terms are intended to be interpreted in accordance with applicable laws. Any governing-law or jurisdiction provisions that apply to a particular service, customer or transaction will be stated in the relevant service terms where required.
